GrowthKind Limited, a company incorporated in England and Wales with company number 16483518 and registered office at 1 Meadow View, High St, Burbage, Marlborough SN8 3AF (“GrowthKind”) is committed to protecting and respecting your privacy and personal data.  

 

GrowthKind is the data processor and will handle your personal data in compliance with the UK GDPR, the UK Data Protection Act 2018, and relevant laws. This policy explains how we collect, store, use, share, retain, and destroy your personal data, as well as your rights and how to contact us or a regulator if you have a complaint. Please read it carefully.

Types of data we collect 

The personal data we collect about you depends on the nature of our relationship with you and/or your particular activities carried out through our website. We may collect and use the following personal data about you: 

 

  • Name, contact details (email, phone number), company information

  • Professional online profiles (e.g., LinkedIn)

  • Information contained in your CV

  • Billing and payment details (e.g., bank account, payment card info)

  • Communications and feedback provided via phone, email, or social media

  • Website activity

  • Information related to the services we provide

  • Contact and transaction history

 

How your personal data is collected  

We collect personal data from you when you contact us (via mobile, email or phone, enter or send us enquiries via our website, when you register with us as a candidate or client and/or when you purchase services from us. 

How and why we use your personal data 

We can only use your personal data for valid reasons, such as:

  • Your consent

  • To meet legal and regulatory obligations

  • To fulfill a contract or take steps before entering into one

  • For our legitimate interests or those of a third party

Legitimate interests allow us to use your data for business reasons, provided your rights are not overridden.

 

Marketing 

We may use your personal data to send updates about our services via email or phone. We have a legitimate interest in marketing, so your consent is not required unless our approach changes, in which case we will ask for your consent.

We may ask you to update your preferences if you request new services or if there are legal or business changes. We never sell your data to third parties for marketing.

 

Who we share your personal data with

We share your personal data with carefully selected third parties who help us run our business and deliver our services. These include technology providers, website hosts, marketing agencies and professional advisors. We share only what each party needs. Every provider is bound by a written contract that requires it to keep your data secure and confidential, and to use it only on our instructions or to meet its own legal obligations.

Atlas (our CRM)

We use Atlas Recruitment Technology Limited as our CRM platform. We chose Atlas partly for its strong security and because the platform is hosted on Amazon Web Services (AWS) in the EU . Atlas is cloud-based software that organises and tracks CVs and candidate information. That includes the roles you may be suited to and, where relevant, your stage in a recruitment process. Its features include applicant tracking, AI notetaking, interview scheduling and onboarding. Please see Atlas' Privacy Policy for more details.

Google Workspace

We use Google Workspace for our email, communication and collaboration. Google's security measures include encryption, certification to industry standards such as ISO 27001, GDPR compliance and advanced access controls. Anthropic (Claude)

We use Claude, an AI assistant from Anthropic, to support our work. For example, we use it to research markets, organise notes, and draft and review documents. We use Claude under Anthropic's Commercial Terms of Service, which means:

  • Anthropic does not use the data we enter to train its AI models.

  • Anthropic processes that data for us under its Data Processing Addendum.

  • Only authorised GrowthKind team members can use our account.

Claude supports our consultants' judgement but does not replace it. A member of our team reviews and makes every assessment, shortlist and recommendation. Claude does not make decisions about you.

Anthropic may process data outside the UK, including in the United States. When that happens, the transfer is protected by the EU Standard Contractual Clauses together with the UK International Data Transfer Addendum issued by the Information Commissioner's Office. Lovable (secure client microsites)

We use Lovable, a web development platform provided by Lovable Labs Sweden AB, to build and host secure, password-protected microsites for our clients during a search. On these sites, a client's hiring team can review information about shortlisted candidates. This may include career history, our assessment and compensation details. To protect this information:

  • Each microsite is password-protected. We share the password only with the named people at the client who are involved in the hiring decision.

  • Search engines do not index our microsites.

  • We include your information only after you have agreed to be presented to that client.

  • We take each microsite down when an offer has been made, and in any event within 7 days of the search concluding.

  • We use Lovable under a business plan and its Data Processing Agreement. That agreement prohibits Lovable from using your personal data to train AI models.

Lovable and its service providers may process data outside the UK, including in the United States. Where this happens, your data is protected by the EU Standard Contractual Clauses together with the UK International Data Transfer Addendum issued by the Information Commissioner's Office. Other parties

We may also share your personal data with:

  • Clients, when you have agreed that we can present you as a candidate for a role

  • External auditors and professional advisors (for example, lawyers and accountants), who are bound by duties of confidentiality

  • Law enforcement agencies, regulators and other public bodies, where the law requires us to

  • Other parties who help us deliver our services to you, where this is needed to perform a contract with you

 

How long your personal data will be kept 

We retain your personal data only as long as necessary to fulfill its purpose, including legal, accounting, or reporting requirements. This may include data for tax and accounting purposes.

Data is regularly reviewed and kept only when necessary. Retention periods are determined based on the data’s nature, sensitivity, potential risks, and legal obligations. Once legal requirements expire, we securely destroy your personal data.

We will delete or anonymise your data after seven years of inactivity with GrowthKind.

 

Your Rights 

It is important that the personal data we hold about you is accurate and current. Please keep us informed if the personal data we hold about you changes.

Policy Changes 

From time to time, we may need to update or modify this policy to reflect changes in our organisation or business practices, data collection practices or legislation. We reserve the right to amend this policy at any time, for any reason, without notice to you, other than the posting of the amended policy on this website. It is recommended to check the website regularly for the most up to date version.
